“right to incarcerate someone charged with certain felonies” the prompt disscuses whether or not the government should be able to hold people without formal charges. Therefore, the us vs salerno ruling
would not be applicable—it discusses people already charged.
“to incarcerate an individual until a speedy trial can get underway . . .” the prompt does not ask should we jail people before/during their trial, it asks should we jail people without charges or an
attorney. There is a fundamental difference in the issues you discuss.
You are somewhat ambiguous, making it hard to see what your opinion on the actual issue is. The last sentence is the first real confirmation of your view, so add something like it before then.
